TERMS OF USE

GoMining Gift is operated by GoMining (Czech) s.r.o., a company incorporated under the laws of Czech Republic (“GoMining”, “we”, “us”). By completing a purchase through GoMining Gift you confirm that you have read, understood, and agree to these Terms of Use.

“Activation Link” means the link embedded in the Gift Card delivery page, attached to the “Activate” button, which redirects the Recipient to the GoMining platform to claim their Digital Miner.

“Buyer” means the person who purchases a Gift Card through GoMining Gift.

“Digital Miner” means the NFT-based digital item allocated to a GoMining account upon redemption, which participates in Bitcoin mining on the GoMining platform.

“Gift Card” means a digital, single-use voucher purchased through GoMining Gift, containing a unique Activation Link redeemable for one Digital Miner NFT on the GoMining platform.

“Gift Link” means the unique digital link delivered to the Buyer upon purchase, which directs the Recipient to the Gift Card delivery page.

 “GoMining Platform” means the Bitcoin mining ecosystem operated by GoMining accessible at gomining.com.

 “Recipient” means the person who receives and redeems the Gift Card.

When you purchase a Gift Card, you receive a digital voucher entitling the holder to redeem one Digital Miner NFT on the GoMining platform. The Gift Card is not a financial product, security, or investment instrument.

A Digital Miner participates in Bitcoin mining on the GoMining platform. Any Bitcoin-denominated rewards generated are variable and depend on Bitcoin network difficulty, hashrate, energy costs, and other external factors. Rewards are not guaranteed. Past reward activity is not indicative of future results.

The specific hashrate allocation and efficiency corresponding to your Gift Card denomination are displayed at product page.

You must be at least 18 years of age to purchase a Gift Card. By completing a purchase you confirm you meet this requirement.

Redemption of the Gift Card on the GoMining platform is subject to additional eligibility requirements set by GoMining, including KYC identity verification, age verification, and sanctions screening. GoMining may block redemption where these requirements are not met. See Section 7 for consequences of a blocked redemption.

Gift links are valid until 31 December 2026. The recipient can open and activate the gift at any time before that date. 

If the Gift Card is not redeemed before the expiry date, the Gift Link and associated Activation Link will be permanently deactivated. No refund, replacement, or compensation will be provided for expired Gift Cards, except where mandatory consumer law in your jurisdiction requires otherwise.

Your Gift Link will be delivered by email and/or through your order dashboard following successful payment. You share this link with your intended Recipient. The Recipient opens the Gift Link, lands on the Gift Card delivery page, and clicks “Activate” to be directed to the GoMining platform where they claim their Digital Miner.

The Activation Link is single-use. To redeem it, visit gomining.com and follow the activation instructions. Redemption requires creating a GoMining account and completing GoMining’s verification process. Once redeemed, the Digital Miner is governed exclusively by GoMining’s Terms of Service at gomining.com/en/terms-eu.  In particular, a Digital Miner activated through redemption of a Gift Card may not be sold, transferred, or listed on the GoMining Secondary Marketplace for a period of ninety (90) calendar days from the date of redemption/activation.

If GoMining blocks activation of the Gift Card via the GoMining platform for compliance reasons (failed KYC, sanctions, restricted jurisdiction, or age requirements), you are entitled to a full refund of the Gift Card purchase price. Contact support@gomining.com your order reference within thirty (30) days of receiving notice of the block.

Our refund policy depends on whether and to what extent the Gift Card has been redeemed and whether Bitcoin rewards have been withdrawn from the GoMining platform.

8.1 Before Redemption

A refund under this Section 8.1 is available only if the Buyer, at the time of purchase, did not already hold an existing GoMining platform account. If the Buyer was already a GoMining platform customer at the time of purchase, no refund is available under this Section 8.1.

An eligible Buyer may request a full refund at any time before activating the Miner on the GoMining platform within thirty (30) days of purchase. If approved:

The Gift Card will be cancelled and the Activation Link permanently deactivated.

The purchase price will be refunded to your original payment method, normally within 5–10 business days.

To request a refund, contact support@gomining.com with your order reference. GoMining may request reasonable confirmation of your eligibility as a condition of processing the refund.

8.2 EEA Right of Withdrawal

If you are purchasing as a consumer in the European Union or European Economic Area, you have the right to withdraw from your purchase within fourteen (14) calendar days of the order date without giving any reason, in accordance with Directive 2011/83/EU.

If you activate the Activation Link before the end of the 14-day period, you expressly request immediate performance of the digital content and acknowledge that you thereby waive your right of withdrawal, in accordance with Article 16(m) of Directive 2011/83/EU.

To exercise your right of withdrawal on an unredeemed Gift Card, contact support@gomining.com

before the 14-day period expires.

8.3 After Redemption 

If you have activated your Digital Miner, no refund is available.

8.4 Non-Refundable Situations

No refund will be provided in the following circumstances:

The Digital Miner has been activated (see Section 8.3).

The Gift Card has expired (Validity Period has passed without redemption).

The refund request is submitted more than 30 days after the basis for the refund arose, except where mandatory consumer law provides otherwise.

The refund request is based solely on changes in Bitcoin price, mining difficulty, or market conditions.

The Gift Card was purchased in breach of these Terms of Use (e.g. by a person under 18).

8.6 Chargebacks

If you initiate a chargeback or payment reversal, the Gift Card and Activation Link will be immediately deactivated. We encourage you to contact support@gomining.com before initiating a chargeback so we can resolve the issue directly.

Bitcoin rewards generated by Digital Miners are variable and not guaranteed. They depend on Bitcoin network conditions, mining difficulty, energy costs, and GoMining’s platform operations, all of which are outside GoMining’s full control. Nothing on GoMining Gift constitutes financial, investment, legal, or tax advice.

To the maximum extent permitted by applicable law, GoMining’s aggregate liability in connection with a Gift Card purchase shall not exceed the purchase price paid for that Gift Card. GoMining is not liable for any indirect, incidental, special, or consequential damages arising from your purchase or use of a Gift Card or Digital Miner.

Nothing in these Terms of Use limits GoMining’s liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

Your personal data collected through GoMining Gift is processed in accordance with our Privacy Policy, available at https://gomining.com/privacy  GoMining’s full Privacy Policy governing the main platform is also available at that address.

These Terms of Use are governed by the laws of Czech Republic. If you are a consumer in the EU/EEA, you also benefit from the mandatory consumer protection provisions of the law of your country of residence.

We may update these Terms of Use from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of GoMining Gift after an update constitutes acceptance of the revised Terms.
